Terms of Service
These Terms govern your use of Caricat.art (the “Service”), operated by PIOTEE LLC (“PIOTEE,” “we,” “us,” or “our”).

1. Service
Caricat.art converts uploaded photos into caricatures and delivers digital outputs.
2. Eligibility (Age)
- You must be at least 13 to use the Service.
- If you are under the age of majority in your jurisdiction, you must have parent/legal guardian permission.
- If you are located in the EEA/UK, you must be at least 16, or have the required parent/guardian permission.
3. Accounts
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
4. User Content and Outputs
4.1 Definitions
- “Inputs”: photos or other content you upload to the Service.
- “Outputs”: caricatures or other results generated from Inputs.
4.2 Your Inputs (Limited Non-Exclusive License)
You retain any rights you may have in your Inputs. You grant PIOTEE LLC a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your Inputs solely to provide, maintain, and secure the Service (including generating and delivering Outputs, preventing abuse, and troubleshooting).
License duration. This license ends when you delete the relevant Inputs or close your account, except to the extent we must retain limited copies for backups, security, dispute resolution, or legal compliance for a limited period.
4.3 Outputs — Plan-Based License (Personal vs. Commercial)
Your license to use Outputs depends on your subscription plan.
4.3.1 Personal-Use Plans
Unless your plan explicitly includes a Commercial License, we grant you a limited, revocable, non-exclusive, non-transferable license to use Outputs solely for your personal, non-commercial purposes.
4.3.2 Commercial License (Creator and other eligible plans)
If your plan explicitly includes a Commercial License (for example, a “Creator” plan), we grant you a limited, revocable, non-exclusive, non-transferable license to use Outputs for commercial purposes, only to the extent:
- the underlying Inputs are your original photos or you otherwise have the rights and permissions to use them (including any required model/property releases);
- your use does not violate any third-party rights (including copyright, trademark, privacy, or publicity rights);
- you do not imply endorsement, affiliation, or approval by any person or brand.
Commercial restrictions. Even with a Commercial License, you must not use Outputs that depict public figures or that are based on third-party IP (e.g., celebrities, characters, brands, logos, or someone else’s photos) for advertising, sponsorships, paid promotions, branding, or merchandising unless you have explicit permission from the relevant rights holders.
We do not guarantee that any Output is non-infringing, unique, or suitable for a particular commercial use. You remain solely responsible for obtaining permissions and for how you use Outputs.
Commercial purpose includes any use intended for, resulting in, or reasonably likely to result in monetary compensation or business benefit, including advertising, marketing, branding, promoting a business or product, paid content, merchandising, resale, NFTs/tokenization, or use as a logo/trademark.
4.4 Rights, Consent, and Responsibility (User-Provided Images)
Inputs may include real photos of people (including faces) and other subjects (including pets). Photos of people may be personal data. By uploading an image, you represent and warrant that you have the rights and permissions to use it (including any required consent from a person depicted), and that your use of the Service will not violate any third-party rights (including copyright, trademark, privacy, or publicity rights).
You are solely responsible for your Inputs, the Outputs generated from them, and how you use or share them. Caricat.art is not responsible for any claims, damages, or losses arising from user-generated content or alleged infringement.
We may remove or restrict content, disable sharing, suspend, or terminate accounts in response to complaints (including DMCA notices) or if we reasonably believe content violates these Terms or third-party rights.
4.5 Similarity / Non-Uniqueness
Due to the nature of automated systems, Outputs may not be unique and may be similar or identical to outputs generated for other users.
5. Acceptable Use
Do not upload illegal, infringing, or harmful content, including content that violates privacy or publicity rights. Do not attempt to disrupt, reverse engineer, or abuse the Service.
Do not use the Service or any Outputs in a way that is deceptive or likely to cause confusion, including by implying that Caricat.art (or any third party) endorses, sponsors, or is affiliated with you or your content.
We may remove content or suspend accounts that violate these Terms.
6. Private by Default; Sharing Links
User-generated Outputs are private by default and are not publicly listed on Caricat.art.
If the Service allows you to create a shareable link, you understand that:
- Anyone with the link may be able to view the shared content (depending on your settings).
- Shared content may be copied, screen-captured, downloaded, or redistributed by others, and removal may not eliminate copies held by third parties.
- You are responsible for how and where you share the link.
6.1 Public Figures and Fan Art (Use at Your Own Risk)
You may create fan art or stylized edits, including content depicting public figures, only if you have the rights and permissions needed to use the underlying image(s). If you share such content, you do so at your own risk.
You must not use any content depicting public figures (or any third-party IP) in advertisements, sponsorships, paid promotions, branding, or merchandising, and you must not suggest endorsement, affiliation, or approval by the person/brand depicted.
We may revoke or disable sharing links at any time to protect users, comply with law, or prevent abuse. Sharing links do not by themselves grant permission for commercial use; commercial use depends on your plan and your rights/permissions.
7. Examples
Caricat.art may display a curated gallery of examples for demonstration and marketing purposes.
Examples are not a public feed of user posts. We use examples that we own, have licensed, or have permission to use (e.g., stock images or model-released photos). We do not use user-generated content as Caricat.art marketing or advertising materials without explicit permission from the rights holder(s).
8. No Sensitive Uploads
Do not upload:
- government ID documents (passport/driver’s license), payment card images, financial account numbers,
- medical/health records, or
- content involving minors without a parent/guardian’s permission, or any other content you do not have the right to process.
9. Third-Party Processing Providers (Indirect Processing)
To operate the Service, we may rely on third-party providers to process Inputs and generate Outputs (for example, AI image processing, hosting/storage, and security). Such processing is performed indirectly through service providers as part of providing the Service.
To the maximum extent permitted by law, we are not liable for interruptions, delays, errors, or failures caused by third-party services or infrastructure that are outside our reasonable control (including acts or omissions of third-party providers). This does not limit any non-waivable rights you may have under applicable law. Your use of the Service remains subject to these Terms and our Privacy Policy.
10. Subscriptions and Billing
Paid plans auto-renew monthly unless canceled. You can cancel in the Stripe billing portal; cancellation stops future charges and you keep access until the end of the current period. Prices may change with notice, and taxes may apply. Payments are processed by a third-party processor; we do not store full card details.
11. Refund Policy
11.1 General Policy
Due to the nature of our services, which consist of digital processing and delivery of Outputs, we generally do not offer refunds once Outputs have been generated, credits have been used, or a billing period has started.
11.2 Exceptions
We may provide refunds or service credits in the following limited circumstances:
- Technical issues or bugs that prevent the proper delivery of purchased services
- Service outages or platform downtime that significantly impact the delivery of purchased services
- Errors on our part in the delivery or execution of purchased services (e.g., duplicate charges)
11.3 Refund Process
If you believe you are entitled to a refund under the circumstances outlined above:
- Contact us at hi.caricat.art@gmail.com within 7 days of the issue occurring
- Provide detailed information about the technical issue or service problem (including relevant timestamps and, if possible, screenshots/receipts)
- We will investigate your claim and respond within 7 days of discovering the issue.
- If approved, refunds will be processed to the original payment method in accordance with Stripe’s policies and processing timelines
11.4 Non-Refundable Services
The following are strictly non-refundable:
- Any services where Outputs have been generated or credits have been used as specified
- Subscription fees for an active billing period (no prorated refunds), except as required by law
- Charges resulting from misuse of your account or failure to cancel before renewal
12. Privacy
We handle personal data as described in our Privacy Policy.
13. Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, please email our designated agent with a description of the copyrighted work, the allegedly infringing material (including its URL or location), and your contact information.

We may remove or disable access to the material and may terminate repeat infringers in appropriate circumstances.
14. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that Outputs are non-infringing, unique, accurate, or eligible for copyright protection.
15. Limitation of Liability
To the maximum extent permitted by law, PIOTEE LLC is not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
16. Indemnity
You agree to indemnify and hold harmless PIOTEE LLC from claims arising out of your Inputs, your use of Outputs, your sharing of content, or misuse of the Service, including any violation of these Terms or third-party rights.
17. Governing Law
These Terms are governed by the laws of the State of Wyoming, excluding conflict of laws principles. Any dispute shall be brought in the state or federal courts located in Sheridan County, Wyoming.
18. Changes
We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
